          I have made some effort to find Cooley’s original manuscript of the address, but have been unsuccessful.  The Bentley Historical Library at the University of Michigan has Cooley's papers.  I have not been there but did write the librarian.  He stated he was unable to find an original copy of the address.  There is this source, which I have not checked:

          Cooley is justifiably regarded as one of the foremost legal sages in American jurisprudence.  Roscoe Pound, dean of the University of Nebraska College of Law and later dean of Harvard Law School considered him to be one of “the ten judges who must be ranked first in American judicial history.”  Cooley’s most influential decisions and writings are in the areas of constitutional and administrative law. 

          Having said that, I consider his essay “The Judicial Functions of Surveyors” to be a little overrated by surveyors.  It is worthwhile reading but there are any number of appellate decisions, including some by Cooley, that I believe have greater insights and show greater wisdom about boundary surveying than “Judicial Functions.”  My mindset may result from the way I was taught surveying in college, in that I was taught by attorneys using appellate decisions.  Cooley opens his address as follows:

“When a man has had a training in one of the exact sciences, where every problem within its  purview  is  supposed  to  be  susceptible  of  accurate  solution,  he  is  likely  to  be  not a  little impatient  when  he  is  told  that,  under  some  circumstances,  he  must  recognize  inaccuracies,  and govern his action by facts which lead him away from the results which theoretically he ought to reach. Observation warrants us in saying that this remark may frequently be made of surveyors.”

          Law is certainly not an exact science and if one considers legal principles to be the foundation of boundary retracement, then surveying training is not fundamentally based on exact science.  The exact sciences of mathematics, physics, etc. are exact in theory only and their application comes into play in surveying only after having made decisions based on law.

          Without getting into the minutia of copyright law, there is no copyright on anything published before 1926.
