<title>Recording plats prepared before 5-8-17</title>

<description><![CDATA[<p>Since HB76 became law in May 2017 I have had several clients asking me to help them record an older plat.&nbsp; Our Superior Court Clerk did not allow ANY plat to be recorded that did not conform to HB 76.&nbsp; For plats that I prepared but were not recorded for one reason or another prior to the above date, I added the 3"x3" block and the new appropriate certification to make them recordable now.&nbsp; It was bugging me that my clients could not record their older plats without having to pay me to update the survey and add the new certifications.&nbsp; <br />

<p>Last week I re-read the "Georgia Plat and Condominium Plan Recording Act of 2017" and noticed this wording at the very end of Section 2:<strong><em> "(i) Any plats or condominium plans prepared prior to the effective date of this Code section in compliance with previous statutory requirements may be recorded pursuant to this Code section so long as such documents are submitted as electronic images and presented to the clerk of superior court electronically."&nbsp; </em></strong>I am probably the only idiot in the state who did not catch this the first few times I read the new law.<br />

I showed this to my clerk here in Monroe County and after conferring with the GSCCCA folks she agreed that she would now record plats prepared before May 2017 if they are submitted electronically and conform to local and state recording requirements as of the date of the survey as the new law requires.&nbsp; If any of you are having trouble recording older plats, show your clerk that part of the code section and hopefully your clerk will see the light.]]></description>

<description><![CDATA[You're not an idiot but SAMSOG did push, as did I and a couple of Clerks to get this into HB76 so that older plats could be recorded without the hassle that you described.  It was on all of the notifications that went out to the clerks.  The disastrous HB1004 from 2016 did not allow for that common sense flexibility, so we made sure that at least some common sense was infused into the "fix" bill.]]></description>
